1Introduction

These Terms of Service (“Terms”) form a legally binding contract between you and Abacus Investment Tracker when you use our website and services. By creating an account or using our service, you agree to these Terms. If you do not agree, do not use the service. Our Privacy Policy explains how we collect and use your data.

2Description of Service

Abacus Investment Tracker is a web-based investment portfolio tracking service. It allows you to:

  • Track investments across stocks, cryptocurrencies and commodities
  • Record transactions (buys, sells, dividends, rewards)
  • Import investments via CSV
  • View portfolio performance, profit and loss, and asset allocation
  • Use multi-currency support (e.g. EUR, USD, GBP) with exchange rates
  • Access prices and exchange rates updated on a regular basis

The service is provided “as is” and features may change.

3User Accounts

Creating an account. You must provide an email address and password to register. You are responsible for keeping your credentials secure and for all activity under your account.

Account suspension and termination. We may suspend or terminate your account if you break these Terms, abuse the service, fail to pay when due, or for other reasons we reasonably consider necessary. If your trial expires without a valid payment method, or your subscription is cancelled or lapses, your access may be restricted or ended. You may close your account at any time through your account settings or by contacting us.

4Acceptable Use

You agree to use the service only for lawful purposes. You will not:

  • Use the service for fraud, money laundering, or other illegal activity
  • Attempt to access other users’ accounts or data without permission
  • Circumvent technical or security measures (e.g. rate limits, authentication)
  • Use bots, scrapers, or automated tools without our consent
  • Overload or disrupt our systems or infrastructure
  • Upload content that infringes intellectual property or other rights
  • Use the service in ways that harm us, other users, or third parties

We may monitor usage to enforce these rules and protect the service.

5Payment and Subscriptions

Free trial. New accounts receive a 30 day free trial. You may be asked to add a payment method; if you do not and the trial ends, your account may be locked. We may send trial reminder emails before the trial ends.

Subscription. After the trial (or when you choose to subscribe), you will be charged according to the current subscription plan.

Payment processing. Payments are handled by Stripe. By subscribing, you also agree to Stripe’s terms. We do not store card details.

Billing. Subscriptions renew automatically unless you cancel. You can cancel at any time through your profile; cancellation takes effect at the end of your current billing period.

Refunds. Refunds are handled according to our Refund Policy (Section 15 below). Contact us for refund requests.

Price changes. We may change subscription prices. We will give notice (e.g. by email) before the change applies to your next billing period. Continued use after the change means you accept the new price.

Past-due payments. If payment fails, we may restrict access until the issue is resolved. We may retry billing and, if it remains unpaid, we may cancel your subscription.

6Intellectual Property

All content on the Abacus Investment Tracker website and service (including text, graphics, logos, design, and software) is owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer our service or content without our written permission.

You retain ownership of the data you input (investments, transactions, etc.). By using the service, you grant us a limited license to use that data as needed to provide the service, as described in our Privacy Policy.

7Limitation of Liability

Disclaimer. The service is for personal portfolio tracking and informational purposes only. It is not investment, tax, or legal advice. We do not recommend or endorse any investment. All investment decisions and their consequences are your responsibility. Past performance and displayed values do not guarantee future results.

Data accuracy. We rely on third-party data for prices and exchange rates. We do not warrant that this data is complete, accurate, or up to date. You use it at your own risk.

Limitation. To the fullest extent allowed by law:

  • Our total liability for any claims relating to the service will not exceed the amount you paid us in the 12 months before the claim, or €100, whichever is greater
  • We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data loss, or business interruption) even if we were advised of the possibility
  • We are not liable for third-party actions, outages, or data errors, including from our data providers.

Some jurisdictions do not allow these limitations; in those cases, our liability will be limited to the maximum extent permitted.

8Indemnification

You agree to indemnify and hold harmless Abacus Investment Tracker and its officers, directors, employees, and agents from any claims, damages, losses, or costs (including legal fees) arising from your use of the service, your breach of these Terms, or your violation of any third-party rights.

9Third-Party Services

The service uses third-party providers, including:

  • Supabase – database, authentication, storage
  • Stripe – payments and subscriptions
  • Resend – transactional emails
  • Upstash – rate limiting
  • Yahoo Finance, Binance, exchange rate APIs – market data and FX rates

Those services have their own terms and privacy policies. We are not responsible for their actions, downtime, or changes.

10Data and Privacy

Our use of your personal data is described in our Privacy Policy. By using the service, you consent to that processing. When you delete your account, we will remove your data within 30 days as described in the Privacy Policy.

11Governing Law and Disputes

These Terms are governed by the laws of the Republic of Ireland, without regard to conflict of law rules. Any disputes will be resolved in the courts of the Republic of Ireland. You may also have consumer rights in your country that cannot be limited by these Terms.

12Amendments

We may change these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. Material changes may be notified by email or in-app notice. Continued use after changes take effect means you accept the new Terms. If you do not agree, you should stop using the service and close your account.

13General

  • Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Abacus Investment Tracker regarding the service.
  • Severability. If any part of these Terms is held invalid, the rest remains in effect.
  • Waiver. Our failure to enforce any right does not waive that right.
  • Assignment. We may assign these Terms or our rights under them. You may not assign your rights without our written consent.

15. Refund Policy

Introduction

Abacus Investment Tracker (“we,” “our,” or “us”) is committed to providing a reliable investment tracking service. This Refund Policy explains the terms under which refunds may be granted for subscriptions or paid services. By using our paid services, you agree to the terms outlined here.

Trial Period

We offer a free trial for new users. During the trial period, you will not be charged, and no refunds are applicable. The trial does not convert to a paid subscription automatically; you must choose to start a subscription if you wish to continue after the trial ends.

Subscription Refunds

Non-refundable by default: All subscription fees are generally non-refundable once the payment is processed.

Exceptional Circumstances: Refunds may be considered at our discretion in cases where:

  • A technical issue prevents you from accessing the service for a significant period, and we are unable to resolve it promptly.
  • Duplicate payments are processed due to an error on our end.

Requests for refunds under these circumstances must be submitted within 14 days of the charge.

  • Your account email
  • Reason for the refund request

We will review your request and respond within 7 business days.

Payment Cancellations

You may cancel your subscription at any time through your account settings. Cancellation prevents future billing but does not automatically trigger a refund for the current billing period.

Third-Party Payment Processors

All payments are processed securely through Stripe. Any refund granted will be issued via the same payment method used for purchase.

Changes to This Policy

We may update this Refund Policy from time to time. Updates will be posted on our website with a revised “Last updated” date.
